Provincial court heard that on Tuesday, Aug. 1, at around 3:30 p.m., Ellis and Hill were spotted by a witness partially naked and having sex on a blanket by a fence at Desbrisay Neighbourhood Park.

The park is located on Desbrisay Crescent in Charlottetown. It has a community garden and playground equipment and is often used by a nearby daycare facility, Crown attorney Emily Campbell said.

No one else was at the park at the time of the offence, though a witness saw them having sex. Police were called and the pair were told to leave. They were later arrested and charged.

Campbell recommended 60 days for the indecent act and 20 days for missing court. She explained that the indecent act jail recommendation was lower for Hill because she didn’t have a criminal record, whereas Ellis had a lengthy one.

Chief Judge Jeff Lantz sentenced Ellis to 60 days in jail for committing the indecent act and 15 days for missing court. He was also sentenced to a year’s probation, including a condition that he stay away from the park during that time.

Hill had been earlier sentenced to 45 days in jail for the act, and an additional eight days on an unrelated theft charge and for missing a court date. She was given 20 days of enhanced credit for time served in pre-sentence custody.
